Taefoo.com, PT Taefoo Global Lyman Societe, and/or their affiliates (TAEFOO) provide you with website features and other related products and services when you visit the Taefoo.com website, conduct searches and purchases on the website (marketplace), use Taefoo devices, products, and services, use Taefoo mobile phone applications, and use software provided by Taefoo in connection with any of the foregoing (collectively, the "Taefoo Services"). Please review our Privacy Notice, Cookie Notice, and Interest-Based Ads Notice to understand how we collect and process your personal information in connection with the Taefoo Services. Taefoo provides the Taefoo Services and offers a hosting space that allows the sale of products and services under the conditions defined in these Terms and Conditions. Taefoo is the trade name used by Taefoo.
Our marketplace is dedicated to and intended for the integration and listing of independent merchants (MS Manufacturers -Suppliers) and (DM Distributors - Merchants) who market and sell food and/or non-food products and services to both professional and individual consumer customers.
User access to the services is as follows: Professional buyer customers who are company directors and/or founders/managers of professional commercial brands with or without a physical retail space/streetfront and/or who operate an e-commerce website and sell food and/or non-food products and/or services have access to the seller stores designated as professional "MS Manufacturers-Suppliers" online on TAEFOO.COM in the country where they are located and in the country where the "MS Manufacturers-Suppliers" sellers are located. They also have access to the online stores on Taefoo.com in other countries on all other continents outside of their country of registration. They must respect and inform themselves about the possible, legal and customs-taxable commercial transactions of each “MS Manufacturer-Supplier” in the country with which they trade online on TAEFOO.COM. They also have access to listings from professional "DM Distributors-Merchants" sellers with their professional seller account or with a second account created in the name of a private individual.
Private buyer customers have access, through their account, to food and non-food products and services listed and published in the stores of professional sellers designated as "DC Distributors-Merchants," and only in their country of residence.
Any use of the taefoo.com marketplace for any purpose whatsoever implies the unconditional acceptance, by the user in any country, of these General Terms and Conditions of Sale and use (GTCU).
ARTICLE 1. DEFINITIONS AND TERMS
Individual Buyer Customers: Individual customer(s) who purchase Products and/or services from Type 1 Sellers listed as "Distributors-Merchants" (DMs) on the Taefoo.com Marketplace platform and only as individuals.
Professional Buyer Customers: Professional customer(s) designated as follows: "Distributors-Merchants (DMs)" who purchase products/services from Type 1 sellers listed as "Manufacturers-Suppliers (FFs)" AND also from Type 2 sellers "Distributors-Merchants (DMs)" on the Taefoo.com Marketplace platform, either with a separate customer account registered as an individual. In short, the professional can have two accounts if he wishes, i.e. as a professional Seller customer if he is registered as a trader/company manager and if he has access to the profession and he can also register as a natural person private buyer customer if he wishes. The general conditions of sale are specific to each case and apply in both cases.
Seller(s): Professional(s) who offer(s) Products for sale on the Taefoo.com Marketplace for Buyers.
Order: refers to the action of purchasing one or more products selected from a professional seller's store and carried out by a customer on the Marketplace.
Content: refers to all information, texts, logos, trademarks, animations, designs, photographs, data, hyperlinks, and generally all elements, information, and content of the Seller published on the taefoo.com Marketplace.
SELLER TERMS AND CONDITIONS: refers to the contractual conditions governing the provision of taefoo.com Marketplace Services by PT Taefoo Global Lyman Societe to Sellers. These Taefoo.com Marketplace Terms and Conditions apply to and supplement the SELLER TERMS AND CONDITIONS. They do not replace or supersede them in any way.
General Terms and Conditions of Sale and Use or "Terms and Conditions": refers to the professional Seller's contract governing the Product Order between the professional Seller and the Customer (professional and/or individual). Each Seller provides their own Terms and Conditions to best regulate the sale of their products through the taefoo.com Marketplace, as needed and at the request of each individual.
Terms and Conditions of Sale and Use of the Taefoo.com Marketplace for Buyers.
Personal Data: Information concerning an individual that allows them to be identified either directly or indirectly by their name, photo, postal address, email address, etc.
PAYPAL: A worldwild Company that handles payments and provides online payment services on Taefoo.com.
GDPR: Refers to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
Payment Organization/Platform: Means the company holding a banking license including PAYPAL, Mastercard, Visa, Amex that provides payment services to Taefoo.com, via PT Taefoo Global Lyman Societe, to enable it to collect payments from Customers and Sellers and then PT Taefoo Global Lyman Societe will remit their respective payments deducted from the commission for taefoo.com to their registered bank accounts.
Login: Refers to the Customer's email address and password, defined by the Customer, which are useful and necessary for accessing their Customer Area on the Website. For the Seller, the login and password, defined when creating their Seller Area, allow them to access this Seller Area, which is strictly personal. If other people who are part of the company or brand can have access to it with the same username and password, this must be reported in advance to Taefoo.com by providing the identity of the person(s) + copy of their ID(s) and/or passport(s). In the event that several people have access to the administration of the seller store area, multiple identities must be provided for internal TAEFOO verifications.
Product Offer or Promotional Offer: means the display of products offered by the seller which consists of the following information: the price, the promotional price if useful, a descriptive and clear Product sheet, the quantity in stock of the product in question, a physical condition NEW or USED, the Material, Size, dimensions, type of packaging, complete description and technical data if useful, type of energy or type of fuel, warranty if there is etc...
Processing: Any operation relating to personal information/data including (collection, recording, organization, conservation, adaptation, modification, extraction, consultation, use, etc...).
ARTICLE 2 - PURPOSE
Natural Lifestyle Limited, with a capital of IDR 425,000,000 (Indonesian Rupiah), headquartered in Jakarta, is accessible from the website www.taefoo.com, published by PT Taefoo Global Lyman Societe, whose identity and contact details are specified in the "Legal Notices" section (hereinafter referred to as the "Site"), as well as on any mobile phone applications.
These General Terms of Use are intended to constitute the rules of use that must be observed by Users of any country whatsoever, whether they are Internet users, Customers, or Sellers, when using the marketplace and all the Services offered there.
The Taefoo.com marketplace offers, through its electronic platform, a service through which professional Customers (DM Distributors-Merchants) will be connected with professional Manufacturers-Suppliers (MS), and individual customers will be connected with distributor-merchants (sellers) for the purchase of organic food or non-food products and/or services.
In this context, it is recalled that Taefoo.com acts as an online platform operator and is a simple intermediary providing technical support through a platform connecting people offering products and/or services, whether professional or private. The role of the marketplace is therefore limited to hosting stores owned by professional sellers offering products and/or services, thereby enabling the connection of Sellers on the Marketplace and the establishment of relationships, in order to trade with confidence and gather feedback through the reputation that each must build throughout their online business activities.
Any user from any country is fully informed that PT Taefoo Global Lyman Societe acts only as an intermediary on the Taefoo.com marketplace in the sale of products and/or services when the product sheet clearly indicates the origin and display of the products on the professional seller's store, whether "FF manufacturer-supplier" or "DM Distributor-Merchant".
The sale of products to Customers resulting from commercial transactions related to and governed by the general terms and conditions of sale accepted by the Customer and the Seller is separate from these General Terms and Conditions of Sale. The terms and conditions of sale of the Seller's products and/or services are governed by its Customer Terms and Conditions of Sale, some of which (shipping costs, terms of return of goods, warranties, etc.) are made available to Customers via the Seller page on the Taefoo.com marketplace. However, if the Customer wishes to review the full General Terms and Conditions of Sale of a Seller, the Seller undertakes to provide them within 3 to 5 business days, in accordance with the Customer's request to Taefoo.com Customer Service. If necessary, the Customer Terms and Conditions may also be made available by the Seller in its Seller Area. The relationship between PT Taefoo Global Lyman Societe and the Sellers is governed by these General Terms and Conditions as well as the Seller General Terms and Conditions accepted and available in the store in the “Seller Area” section of each professional Seller. "Marketplace": refers to the online platform accessible from the Website www.taefoo.com. The Marketplace is a space on the taefoo.com website where only third-party Sellers sell products and/or services, through Taefoo.com, acting as an online platform intermediary on the web, but without having any direct connection or interaction with the commercial actions carried out between professional sellers and/or individual customers, but solely benefiting from the publication of their company/brand on the taefoo.com marketplace. The remunerated income that allows Taefoo to survive is solely from collecting commissions taken from sales made + a subscription fee for publication and use of the marketplace platform and for management, communications, and verification of all kinds.
"Product": refers to any product, food or non-food (new or used), or service that may be offered and sold by Professional Sellers to Customers via the taefoo.com Marketplace.
“Service”: refers to all services offered by Taefoo.com to Users through the Marketplace, as defined in Article 8 of these Terms and Conditions, and in particular the connection between Customers and Sellers.
“Site”: refers to the website www.Taefoo.com hosting the Marketplace, where taefoo.com acts as an intermediary and online platform operator. Use of the Site is governed by the present Terms and Conditions of use. (https://www.taefoo.com/notre-marketplace/cgvu)
"User": refers to any person in any country who accesses and browses the taefoo.com Marketplace, whether a Seller, a private and/or professional Customer, or a simple, curious Internet user.
“Seller”: refers to any professional seller, whether Type 1 or Type 2, who has subscribed to the Services offered by TAEFOO.com and whose products and/or services are sold to customers on the Marketplace.
Type 1 Seller: refers to any professional SM Supplier Manufacturer seller who has subscribed to the services offered by TAEFOO.COM and whose products and/or services are sold to customers on the marketplace.
Type 2 Seller: refers to any professional DM Distributor Merchant seller who has subscribed to the services offered by TAEFOO.COM and whose products and/or services are sold to customers on the marketplace.
ARTICLE 3. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF USE
Use of the features and Services of the TAEFOO.COM Marketplace implies acceptance of these Terms and Conditions by the user.
By using the TAEFOO.COM marketplace, the User agrees to carefully read these Terms and Conditions of Use before and/or when accessing the Marketplace and is encouraged to download them in order to fully understand and assimilate them, and to print them if necessary and keep a copy.
It is specified that these Terms and Conditions are referenced at the bottom of each page of the TAEFOO.COM Marketplace by means of a hyperlink (https://www.taefoo.com/notre-marketplace/cgvu) and can be consulted via this link at any time.
The Customer must check a box when paying for their Order indicating their acceptance of these General Terms and Conditions of Sale (GTCSU).
The Seller must check a box during the registration process indicating their acceptance of these General Terms and Conditions of Sale (GTCSU).
ARTICLE 4. TECHNICAL SPECIFICATIONS
By using the TAEFOO.COM Marketplace, the User acknowledges that they have the necessary means and skills to use the features offered on the TAEFOO.COM Marketplace. However, if information or assistance can be provided to a registered user with a username and password, they may submit their request via email to generaladmin@taefoo.com and will receive a response as soon as possible.
The equipment, devices, and internet subscriptions required to access and use the TAEFOO.COM Marketplace are the sole responsibility of the User, as are any usage fees.
ARTICLE 5. ROLE OF TAEFOO.COM
5.1. TAEFOO.COM's Scope of Operation The www.taefoo.com Website allows Internet users from any country to access products that comply with TAEFOO.COM's ethical charter and also to access the TAEFOO.COM Marketplace, dedicated to listing products from Sellers who offer products and/or services to Customers/Consumers.
The TAEFOO.COM Marketplace consists of connecting Sellers and Customers electronically for the purpose of a commercial relationship and the sale of Products and/or services. TAEFOO.COM acts as an intermediary and online platform operator on the Marketplace.
On the Marketplace, TAEFOO.COM exercises no influence or control over the selection of products and/or services, nor over the execution of sales of Products and/or services, and is not involved at any level in the transaction carried out and activated between the Customer and the Seller.
The sales contract (i.e., after checking the T&Cs published by the Seller) is therefore concluded exclusively and directly between the Customer and the Seller. TAEFOO.COM acts solely and exclusively as a technical intermediary enabling the seller-customer connection.
TAEFOO allows third-party sellers to list and sell their products on TAEFOO.COM; in each of these cases, this is indicated on the respective product detail page. Although TAEFOO, as a host, facilitates transactions carried out on the TAEFOO Marketplace, TAEFOO is neither the buyer nor the seller of third-party sellers' products. TAEFOO provides a meeting space in which buyers (customers) and sellers complete and finalize their transactions. Accordingly, for the sale of products from third-party sellers, a sales contract is formed solely between the buyer and the third-party seller. TAEFOO is not a party to such a contract and assumes no liability arising from such a contract or in connection with such a sales contract. TAEFOO is neither the agent nor the representative of the third-party sellers on TAEFOO.
Except as otherwise provided in this section, the third-party seller is responsible for the sale of its products and for any claims or other issues arising from or related to the sales contract between it and the buyer (customer). Because TAEFOO wants the buyer (customer) to benefit from the safest and most supervised shopping experience, TAEFOO offers the A-to-Z Guarantee in addition to any contractual or other rights.
The selection of product publications and all pricing information, descriptions and delivery details, delivery times, returns, and warranties (if applicable) are established exclusively by the Sellers. However, if a product does not comply with the TAEFOO.COM charter and ethics regulations, it is or will be immediately removed from the Seller's store and the Seller will receive a warning. The Seller must correct and ensure that such errors are not repeated, both for the sake of TAEFOO's reputation and its own. We attach great importance to ethics and professional conduct, although we cannot identify any deviations in real time and remove them, but our team checks each store and its products. A customer can report a product that is unethical or does not comply with our charter and internal regulations.
5.2. General Pre-Contractual Information Obligation: Fairness, Clarity, and Transparency
As an online platform operator, TAEFOO.COM acts neutrally, without bias, and in a clear and transparent manner.
The product offerings on the TAEFOO.COM Marketplace are presented through a thematic search engine powered by product-related keywords. They are also accessible in the various sections offered.
In the search engine, the product offerings can be ranked according to these main parameters:
The "Relevance" of the offerings: Products are ranked based on the number of times the searched word (or list of words) appears in the Product sheet or based on the word's position within the Product sheet. For example, a Product sheet whose "Title" contains the searched word will be considered more relevant by the search engine than one if the word appears only in the "Product Description."
“Best Sellers”: the ranking of the offers proposed consists of a statement of several elements: the total number of sales of the same product, the traffic generated by this same product and many other criteria which allow the Customer to be informed about the most sought-after and/or requested Products. A photo display of the most requested popular products is done automatically on the TAEFOO.COM website.
The first product will therefore have the best overall rating based on these selection criteria, compared to all other products matching the same search and keywords.
In the department pages, the ranking of products and Offers can be done as follows:
"Product Type": The ranking of product offers is done by product category (e.g., dairy products and cheeses) and then by subcategory (e.g., dairy products, cheeses, or goat cheese);
"Best Sellers": The ranking of product offers consists of an evaluation and estimation based on several criteria: including the total number of sales of the same product, the total traffic generated by the same product, and much more. These criteria allow us to inform the Customer about the most requested and best-selling products.
ARTICLE 6. EVALUATION OF CUSTOMER SATISFACTION RELATED TO THE PRODUCT(S) PURCHASED AND THE SERVICE PROVIDED BY THE SELLER
After confirming receipt of their Order via their Customer Area, the customer will receive an email invitation, i.e., an evaluation/satisfaction questionnaire allowing them to evaluate their purchasing experience and, in particular, the quality of the service provided by the Seller/store/brand.
The Seller will be evaluated according to the following criteria:
Overall satisfaction with the seller (rating from 1 to 5)
Delivery in accordance with the seller's commitments or not
Delivery deadline met, fast, on time, with a slight delay, etc.
Seller customer service (responsiveness, response time, seller contact experience)
Item conforms to the description or not
Additional comments
The results of these evaluations are published on the seller's store page on the TAEFOO.COM Marketplace and can be viewed by the seller in their Seller account and by other users/customers. The results of these evaluations will allow TAEFOO.COM to verify the Seller's compliance with its commitments to the Customer as well as the professional conduct and ethics of the TAEFOO.COM marketplace.
Using the same evaluation process, the Seller's performance will be assessed using efficiency indicators for order validation, product shipping time, product delivery time, and the effectiveness of its communication and customer service.
These indicators will be continuously monitored to allow TAEFOO.COM to measure the brand awareness and quality of service provided by the Sellers. Failure to comply with these indicators may, unconditionally and after careful review, result in the deactivation of the Seller's Store, in accordance with the conditions indicated in the SELLER Terms and Conditions section.
ARTICLE 7. CONDITIONS OF ACCESS TO TAEFOO.COM AND REGISTRATION CONDITIONS
Any User may access the TAEFOO.COM Marketplace, view the products offered for sale by sellers, and benefit from the services described in these Terms and Conditions.
Users wishing to become Customers or Sellers are invited to follow the steps described below:
7.1. Registration as a Type 1 Manufacturer/Supplier MS Seller or Type 2 Distributor/Merchant DM Seller
To be listed and registered with their own store on the TAEFOO.COM Marketplace, the Type 1 Manufacturer/Supplier FF or Type 2 Distributor/Merchant DC Seller candidate is invited to register their business/company or any other legal form related to their activity in the country in which they reside or in which their business/company/brand is registered. The registration form must be completed in the strictest and complete sense by following the steps without omitting any steps and/or information. A verification of all data will be done internally and then the candidate seller will receive a response within a maximum of 3 to 7 working days for either a request for additional information or approval of his account so that he can start and create his store with his products.
7.2. The registration and contractual relationship between TAEFOO.COM and the Type 1 or Type 2 Seller wishing to offer their products on the Marketplace are governed by the Seller Terms and Conditions, which will be provided to them during the registration process and which they must accept.
During the registration process, the Type 1 or Type 2 Seller will be required to provide certain information regarding their professional business status and a description of their activity. This information must be accurate, complete, and updated in real time in the event of any changes or developments.
For the Seller's store to be active and operational, the only way to activate the Seller's store is to open an account in the name of the Seller or their company/firm with the Marketplace's PAYPAL payment institution. The terms of use for this payment account are defined in the PAYPAL payment services terms and conditions, which will be provided during the registration process. The Seller must read and accept these terms and conditions in order to proceed and complete their registration. The PAYPAL payment service is an integral part of the Marketplace Services. It cannot be separated from other Services.
The Mastercard, Visa, and Amex credit card payment service is also an integral part of the TAEFOO.COM Marketplace Services and cannot be separated from other services.
Once the seller has provided all the requested supporting documents, TAEFOO.COM will verify the information provided and request additional information and supporting documents if necessary. TAEFOO.COM reserves the right to accept or reject the registration of a Seller/company/brand based on several criteria, such as its status and evidence attesting to its organic and ethical products, and their compliance with the rules and philosophy of TAEFOO.COM.
7.3. Registration as a Manufacturer/Supplier Seller - FF Type 1 and Type 2
Distributor/Merchant DC. The subscription payment is made through a quarterly, half-yearly or annual subscription system subscribed to and accepted by the professional Seller customer who will receive the General Terms and Conditions and his contract during his registration steps, to be accepted, signed and returned by email to generaladmin@taefoo.com in PDF, JPG, PNG file ONLY, Taefoo.com administrative service.
However, the first quarter of registration and sharing on TAEFOO.COM is free (and if already in progress with e.g.: 15 days or 1 and a half months already started, the remaining free period will be calculated on his invoice for the following quarter) and then the invoices for the following quarter will be sent to him during the last month of the current quarter.
The quarterly invoice for publication as a Professional Seller and use of the Taefoo.com marketplace services must be paid within 15 days to a credit card account that will be provided in the contract sent by the Taefoo administrative section.
If the quarterly subscription amount is not received within 15 days, a single reminder will be sent to the Professional Seller with a reduced payment deadline of 5 days, stating "TO BE PAYED IMMEDIATELY." However, if, after the reminder, no payment is made by the end of the second specified deadline, the seller's store will be immediately deactivated within the following days, and access will no longer be available. There will be only one option left to reactivate their account and store: contact us by email at generaladmin@taefoo.com.
A minimum one-year contract is required, and this is the timeframe during which the growth and online visibility of our TAEFOO marketplace will gradually increase, as will the seller's brand/store, which will be visited by more and more users. We are a global community, and it will take some time to promote your online store on taefoo.com. Our teams will use all useful and effective SEO channels to boost Taefoo.com in search engines.
As soon as the seller's/brand's/Company's registration is validated by TAEFOO.COM, the Seller Space will be activated internally, and the SELLER Terms and Conditions will apply from that date. The Seller will then be able to create their store and publish and list their products, create their catalog, and begin selling.
Access to their seller store requires computer equipment and all necessary tools, as well as an internet connection. They access it using their registered username and password, which are therefore their sole responsibility. However, if a third party needs to access the same SELLER store, this person must be informed, and a copy of their identity must be submitted to TAEFOO.COM. The seller user must accurately provide all useful information about each of their products published on their store. He will have to provide a complete description of the product, useful technical information if related to a product such as telephony, household appliances, etc., sizes, colors, sizes if related to textiles, clothing, luggage, its approximate and/or exact delivery times depending on the method displayed and offered on his store, delivery method, he will have to specify his conditions in the event of a guarantee applicable to the product, the return procedures in the event of a problem. The TAEFOO.COM administrative service will remain at your disposal if necessary or for any useful assistance.
TAEFOO POLICY ON COMBATING COUNTERFEIT AND/OR COPY PRODUCTS
Products offered for sale on TAEFOO.COM must be authentic, and it is the seller's responsibility to verify them before publication. The sale of counterfeit products is strictly prohibited by law. Failure to comply with this policy may result in the loss of your selling rights, the suspension of your payments, and the closure of the seller's store.
ACCESS TO SELLER STORES TYPE 1 AND TYPE 2 SELLER
Individual customers will only have access to seller profiles with the "Distributor-Merchant DM" store displayed on their page. Individual customers will not have access to "Manufacturer-Supplier MS" seller stores.
Professional "Distributor-Merchant DM" seller customers will have access to seller profiles with the "Manufacturer-Supplier MS" stores displayed on their page, as well as to seller profiles with the "Distributor-Merchant DM" stores. The "Manufacturer-Supplier MS" seller customer will have access to the "Distributors-Merchants DC" seller profiles with stores as well as the "Manufacturer-Supplier FF" seller profiles with stores.
7.4. Registration as a Private Customer
Any User wishing to access all the features offered by the TAEFOO.COM Marketplace must first create a Customer Area in order to become a Customer.
Creating a Customer Area will allow the Customer to purchase Products offered by Merchant Distributors (DCs) on the TAEFOO.COM Marketplace.
Registration on the TAEFOO.COM Marketplace as a Private Customer is free.
To create a Customer Area, the User is asked to provide certain information such as:
Last Name, First Name
Date of Birth
Postal Address / Delivery Address
Telephone Number
Email Address
Verifications will be conducted internally at taefoo.com
The User wishing to become a Customer undertakes to provide accurate, truthful, and up-to-date information that does not infringe, in any way, the rights of third parties and to comply with the Terms and Conditions of the TAEFOO.COM platform.
The Client agrees to create only one unique Client Area. TAEFOO.COM declines all responsibility for any harmful consequences that may result from the misuse of multiple or other Client Areas for a single Client.
The Client is solely responsible for the accuracy and updating of the data provided when opening and managing their Client Area.
7.5. Logins
The Customer shall be solely responsible for the use of their Logins and passwords, and for any actions taken through their Customer Area.
In the event that a Customer discloses or uses their Logins improperly or in a manner contrary to their intended purpose, TAEFOO.COM may suspend the Customer Area and its use.
Under no circumstances shall TAEFOO.COM be held liable for any identity theft of a Customer. Any access and actions taken from a Customer's Customer Area shall be presumed to have been carried out by that Customer, as TAEFOO.COM is not obligated and does not have the technical means to verify the identity of persons accessing the Marketplace from a Customer Area.
Any loss, misappropriation, or unauthorized use of a Customer's Identifiers and their consequences are the sole responsibility of the Customer, who will be required to notify the Site without delay via the following email: complaints@taefoo.com
7.6. Customer Unsubscription
The Customer may deactivate and/or close their Customer Area at any time via the contact form provided on TAEFOO.COM. The TAEFOO.COM administration will deactivate the Customer Area within 7 business days and send the Customer an email confirming the closure of their Account and the permanent deletion of all their information on the Website, including the Marketplace, with the exception of information required to be retained by law.
ARTICLE 8. TAEFOO.COM SERVICES
8.1. Services Offered to All Users
Any User from any country may access the TAEFOO.COM Marketplace and its various features free of charge.
The main Service offered by TAEFOO.COM consists of offering any User from any country the ability to browse Products listed by category in order to order and purchase them from Sellers listed on the TAEFOO.COM Marketplace.
8.2. Searching by section pages / following page by page
The User may browse and access the different Product categories through the sections offered within the section pages.
8.3. Personalized search using the search engine
The User may use the search engine to search for a specific product.
The search engine operates using keywords entered through the search engine. In this case, the results corresponding to the search will be presented in accordance with the criteria set out in Article 5.2 of these Terms and Conditions.
8.4. Services Offered to Customers
By creating their Customer Account in accordance with Article 7.2 of these Terms and Conditions, any adult and legally responsible Customer from any country may access the following features:
8.5. Product Orders
Any adult and legally responsible Customer from any country may place an Order for Products offered by Sellers via the Marketplace.
Any Order for selected Products made on the TAEFOO.COM Marketplace will be governed by the General Terms and Conditions of Sale of the stores of the selected Seller(s).
All Offers displayed on the Sellers' stores are created and completed by the Sellers, who are solely responsible for the description provided by product, the conformity of the Product and the determination of the product's sale price. The prices displayed include all taxes, i.e. VAT. Delivery costs are excluded but must be added to the total price displayed at the end of the customer's order. Otherwise, delivery costs, the type of which must be selected in the event of multiple choices offered by the seller, must be added to the price of the Product before the final validation of the Order.
The TAEFOO.COM Marketplace recommends that Customers carefully read the Seller's delivery and return policy, as indicated by the latter on the Seller Page, and verify the contents of the Order.
After confirming the contents of their Order and accepting their obligation to pay for the Order, the Customer will definitively validate their Order by making their actual payment. The Order will only be valid and processed once the Seller has accepted the Order and paid the full price of the Product. Payment will be made by authorized credit card or through the specified payment institution, i.e., PAYPAL.
The Customer will be informed of the Seller's acceptance of the Order by sending an Order confirmation email. The Seller has 48 to 72 business hours (forty-eight to seventy-two hours) to accept the Order. The TAEFOO.COM Marketplace then notifies the Customer by email of the acceptance of their order or of the Seller's failure to respond, delay, or other issue.
Upon and after confirmation by the Seller, the Customer is debited by the TAEFOO.COM Marketplace for the amount of the Products purchased from its store.
The Seller, after receiving an email confirming an order placed by a customer, must confirm each Order within a maximum of 72 business hours following receipt of the information in their Seller Account. If the Seller fails to accept the order(s) within this period, the Customer will not be charged the amount of the Order, which will then be automatically canceled by TAEFOO.COM.
8.6. CUSTOMS AND TAXES
As a Seller with access to the "FF Manufacturer-Supplier" seller stores, when a user orders products on TAEFOO.COM for delivery outside the European Union or outside other continents from countries in Asia, Africa, etc., the user must take into account the fact that they may be subject to customs duties and taxes on imports, which are levied when the package/order arrives at its destination. At this level, you are responsible for informing yourself about these customs duties and taxes related to each country in which your "FF Manufacturer-Supplier" is located, from whom you have ordered/purchased products/goods. Any additional customs clearance fees will be your responsibility; we have absolutely no control over or intervention over these fees. Customs policies vary greatly from country to country, so you should contact your local customs office for the best information. Furthermore, please note that when ordering from TAEFOO.COM, you are considered the official importer in law and must comply with all laws and regulations of the country in which you are receiving the products/goods.
Protecting your privacy is important to us, and we draw the attention of our international customers to the fact that cross-border deliveries may be opened and inspected by the customs authorities of the country(ies).
8.7. Accepted Payment Methods
The payment methods accepted for any order placed on the TAEFOO.COM Marketplace vary by country and are specified in each seller's store. Credit cards: Mastercard, Visa, and Amex are the main ones, along with PAYPAL.
It is specified that the payment methods offered to Customers through the TAEFOO.COM Marketplace are provided by the payment institution PAYPAL and Mastercard, Visa, and Amex.
8.8. Customer Order Management
After creating their Customer Account, the Customer will then have access to their account and will be able to track and manage their current orders in real time. The Customer will always be able to access the history of all of his Orders as long as they are being processed and then these will be recorded in his customer area.
As a seller of the Products online on the TAEFOO.COM marketplace, the Seller is responsible for the proper execution of the sales process of his Products on the TAEFOO.COM Marketplace and this vis-à-vis the Customer (the processing and tracking of the Order within the given time frame, the shipping and delivery of the products ordered by the customer, the complete Customer service as well as the after-sales service (SAS).
8.9. Services Offered to Sellers with an Online Store on TAEFOO.COM
The Services offered by TAEFOO.COM to Sellers through the TAEFOO.COM Marketplace are as follows:
The "TAEFOO.COM Marketplace" service, i.e., the main Service provided by TAEFOO.COM, consists of providing the software solution generating the Marketplace, which allows the Seller to create their Store and upload their products according to the file type provided for the products, i.e., JPG, PNG, PDF, while integrating their product catalog. Through this service, they connect with Customers who visit their Store and place orders and purchase products using the Services and payment facilities provided by the specified Payment Institution (PAYPAL) and Mastercard, Visa, and Amex credit cards.
Other "Ancillary Services" means any service that may be provided by TAEFOO.COM in conjunction with the TAEFOO.COM Marketplace Service.
"Payment Services": i.e., the payment solutions displayed and the associated payment services provided by the payment institution PAYPAL, which allow Taefoo to receive the amounts paid by Customers, and Taefoo will then pay the amounts less fees into their registered bank accounts.
Once the Seller's registration has been verified and validated by the TAEFOO.COM administration, TAEFOO.COM will then authorize access to the Seller's Product Offerings through categories complementary to those offered on the TAEFOO.COM marketplace.
In order to continue to thrive while paying the staff who enable TAEFOO.COM to operate without interruption, and in return for the Services provided by TAEFOO.COM, TAEFOO.COM is compensated through commissions deducted from each sale and transaction completed through the final action of confirming the purchase of products by the customer. A quarterly, semi-annual, or annual subscription is also paid by any Seller whose store with their products is listed on the TAEFOO.COM marketplace.
Sellers are invited to send an email using the contact@taefoo.com form to learn more about the seller services offered by TAEFOO.COM, as well as the financial terms and conditions.
8.10. 14-DAY RIGHT OF WITHDRAWAL, EXCEPTIONS TO THE RIGHT OF WITHDRAWAL, OUR LEGAL 30-DAY RETURN POLICY + DIFFERENT LEGAL DEADLINES RELATED TO EACH COUNTRY ARE APPLICABLE.
LEGAL RIGHT OF WITHDRAWAL
In European countries, the USA, and Canada, and in accordance with the legal provisions in force in each country, and unless one of the exceptions listed below applies, you have the right to withdraw from your order by providing a reason within 7 to 14 days from:
The date on which you, or a third party designated by you, a neighbor, family member, or other person (other than the carrier/deliverer), took physical possession of the purchased goods (or the last good, batch, or part if the contract concerns the delivery of several goods or several batches or parts delivered separately) or;
The date on which you entered into the contract for the provision of services.
The 14-day period begins on the day after you take possession of the purchased goods. If this period expires on a Saturday, Sunday, or public holiday, the expiry date is extended to the following business day. Certain items, listed below in the "EXCEPTIONS TO THE RIGHT OF WITHDRAWAL" section, are not eligible for return (e.g., fresh and perishable food products within a few days and/or at the latest by the indicated deadline and/or damaged products). Photos and videos must be provided and sent to the seller at the seller's request, if necessary.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the legal provisions in force in each country, the right of withdrawal does not apply to:
The delivery of products that cannot be returned for reasons of hygiene or health protection, if you have unsealed them or, after delivery, have been inseparably mixed with other items or products;
The delivery of audio or video recordings or computer software when you have unsealed and unpacked them after delivery;
The delivery of products that have been made to your specifications or are clearly personalized;
The supply of products that are likely to deteriorate or expire rapidly;
The supply of services fully performed by the seller for which you have agreed to us commencing performance at the time of placing your order, and waived your right of withdrawal;
The supply of newspapers, periodicals, magazines, or books, with the exception of subscription contracts for these publications; the supply of digital content (including applications, digital software, e-books, MP3s, etc.) that is not supplied on a tangible medium (e.g., on a CD or DVD) if you have agreed, when placing your order, that we begin supplying it before the end of the withdrawal period and waived your right of withdrawal.

ARTICLE 9. USER OBLIGATIONS and TAEFOO.COM Commitments
9.1. User Obligations in General.
When using the Marketplace, each User from any country who operates/uses the taefoo.com marketplace undertakes not to violate the rules and regulations related to the use of a marketplace, and in this case, the TAEFOO.COM marketplace, and to comply with the laws and regulations in force in each country governing the use of a marketplace. They undertake to respect the rights of third parties and the provisions of these General Terms of Use and to never exceed their rights, freedoms, and duties, as well as those of third parties.
Each User from any country is required to behave with integrity, honesty, and loyalty without offending, threatening, or insulting sellers and any other users of the TAEFOO.COM marketplace or third parties.
Each User from any country must be honest and truthful when transferring the information provided to TAEFOO.COM and, where applicable, to third-party users of the TAEFOO.COM platform.
Each User from any country of the TAEFOO.COM Marketplace, in accordance with its purpose as described in these Terms and Conditions,

Not to misuse the purpose of the Marketplace to commit crimes, offenses, or contraventions punishable by the Penal Code or any other laws applicable in each country;
Each user from any country must not perform substantial or repeated extraction of information content from the TAEFOO.COM Marketplace in a manner that infringes TAEFOO.COM's database producer rights.
Each user from any country must respect the privacy of third parties and the confidentiality of exchanges taking place on the TAEFOO.COM Marketplace.
Each user from any country must respect TAEFOO.COM's intellectual property rights relating to the elements of the TAEFOO.COM Marketplace and, where applicable, the intellectual property rights of other Users.
Each user from any country must not and may not, under any circumstances, copy data, text, and/or any content published on the TAEFOO.COM Marketplace. Laws protecting personal data on any website are protected by intellectual property rights as well as the laws governing global marketplaces and e-commerce.
Users from any country may not, under any circumstances, modify the information posted on TAEFOO.COM;
Users from any country may not, under any circumstances, use the TAEFOO.COM Marketplace to send mass advertising messages of any kind.
Users from any country may not, under any circumstances, disseminate data that could diminish, disrupt, slow down, or interrupt the normal operation of the TAEFOO.COM Marketplace.
Users from any country may not, under any circumstances, make comments that are insulting, discriminatory, hateful, defamatory, racist, xenophobic, revisionist, supremacist, and/or that undermine the honor and/or reputation of others. Their language in exchanges/communications/negotiations must be polite, considerate, respectful, and courteous.
Users from any country must not and may not, under any circumstances, disseminate images or information of a pedophilic nature. Any attempt to cause harm and/or any misconduct will be reported to the authorities, and legal action will be taken against any person(s) who violate the law. Users from any country may not, under any circumstances, incite the commission of an offense, crime, or act of terrorism, or promote war crimes or crimes against humanity. Any violation of our rules and regulations will be reported to the authorities, prosecuted, and severely punished by the law of the country.
Users from any country will not, directly or indirectly, incite or permit the introduction of pirated software, or any hacking or intrusion into the TAEFOO.COM marketplace in order to destroy or attempt to disable it. It will prevent the introduction of viruses through any malicious file downloads or other means and, in general, will avoid endangering the safety of people and the property of others.
Users from any country will avoid using harmful commercial methods such as (prospecting, soliciting, prostitution, and any other harmful and immoral actions, etc.).
9.2. TAEFOO.COM Obligations
TAEFOO's general obligation is an obligation of means. TAEFOO is not bound by any obligation of results or enhanced means of any kind beyond what is incumbent upon it as a provider of online dating and commerce between sellers and customers.
TAEFOO undertakes to use all means to ensure continuous access to and use of the TAEFOO.COM Marketplace, 7 days a week, 24 hours a day, 365 days a year. TAEFOO, however, draws Users' attention to the fact that current Internet communication protocols do not allow for the absolute and continuous transmission of electronic exchanges (messages, documents, identity of the sender or recipient) to be guaranteed. It is necessary to take into account possible bugs and other server problems or other problems that are completely beyond the control and independent of TAEFOO.
TAEFOO nevertheless undertakes to provide clear and transparent information in real time about any problems that may arise and will do its best to resolve any problems encountered during the operation of TAEFOO.COM as quickly as possible.
ARTICLE 10. SELLERS' TAX AND SOCIAL OBLIGATIONS RELATED TO EACH COUNTRY
The Seller is solely responsible for the collection and payment of all taxes, duties, contributions, or eco-contributions on its sales, as well as for the payment of customs duties and any import and export duties on its products, in accordance with the commercial laws of its country.
It is also responsible for the payment of all taxes, VAT, royalties, and/or remuneration related to the products sold on the TAEFOO.COM Marketplace, regardless of the country from which it operates. As a seller, the Seller is required to generate a sales invoice for the product(s) sold on the TAEFOO.COM Marketplace that meets the applicable legal and tax requirements of the country in which it operates, if the Customer expressly requests it.
The Seller will send the invoice to the Customer via order messaging upon request or make it available in the Customer's area on the Marketplace, in a non-editable format, incorporating the data provided at the time of the Order and complying with the required legal and tax information.
As a registered Seller operating through their store and generating revenue on the TAEFOO.COM Marketplace, they are required to comply with and comply with the tax and social security obligations related to the regulations of the country in which they operate.
The information sheets, links, and all useful information enabling them to fulfill their monthly, quarterly, and annual duties, obligations, and taxes must be reviewed, tracked, and tracked on the government websites of each country in which each seller operates.

ARTICLE 11. RESPONSIBILITIES / MAINTENANCE AND EXTREME CASES
11.1. General Principles

TAEFOO shall not be held liable in the event of delay or non-performance of its obligations, when the cause of the delay or non-performance is related to a case of force majeure as defined above in these Terms and Conditions;
TAEFOO shall not be held liable under any circumstances in the event of an external or external cause not attributable to TAEFOO.COM;

Users acknowledge that TAEFOO.COM is a hosting provider that allows the registration and use of a store offering products for sale online.
As such, TAEFOO reserves the right to remove any content reported to it and deemed, after verification, to be illicit and/or not in compliance with the rules of ethics and/or business conduct. Notification of manifestly illegal content by a User or any other third party must be made via the Customer Area using the TAEFOO CONTACT form – complaints@taefoo.com

11.3. Disputes between Customers and Sellers or Type 1 Sellers and Type 2 Sellers on TAEFOO.COM
Any dispute arising between a Customer and a Seller must be resolved between them as a matter of priority, with the Seller remaining solely responsible for the execution of the Product Order placed by the Customer via the TAEFOO.COM Marketplace. The Customer may contact the Seller by email, which can be found in their Customer Area.
The Seller must provide a response to the Customer as quickly as possible, depending on the nature of the complaint, and within a maximum of 3 business days.
TAEFOO is not and will not be involved in any sales transaction or contract concluded between a Customer and a Seller, and will therefore not be held responsible for intervening in any disputes that may arise between the Seller and Customers.
Nevertheless, in order to best satisfy Customers in the event that no solution has been provided to the Customer, the Seller expressly mandates TAEFOO to intervene to ensure the resolution of the dispute if the Seller has been unable to resolve it within an acceptable timeframe.
In the event of a problem with one or more products, and if the Customer's dispute is justified, the Customer may obtain a replacement or refund, upon return of the Product, if applicable, if no solution has been provided to the Customer within 8 business days from TAEFOO becoming aware of the dispute. The intervention of the administrative service will have no other impact or position than that of observer and help, advice in resolving problems and/or conflicts between the parties.
ARTICLE 12. FORCE MAJEURE
The User or TAEFOO shall not be held liable if the non-performance or delay in the performance of any of their obligations described in these Terms and Conditions results from a case of force majeure.
Force majeure exists in contractual matters when an event beyond the debtor's control, which could not reasonably have been foreseen at the time the contract was entered into, and whose effects cannot be avoided by appropriate measures, prevents the debtor from performing its obligation.
If the impediment is temporary, performance of the obligation is suspended unless the resulting delay justifies termination of the contract. If the impediment is permanent, the contract is automatically terminated and TAEFOO or the User will be released from their obligations under the conditions provided for in the articles legislating the actions to be taken in this specific case and this related to each country in which the TAEFOO.COM marketplace is used by anyone. In the event of a recurrence of one of the events mentioned below, TAEFOO will endeavor to inform the user as soon as possible.
ARTICLE 13. INTELLECTUAL PROPERTY
13.1. Ownership of Intellectual Property Rights of Professional Sellers on TAEFOO.COM
As part of the sale of Products via the Marketplace, Sellers may present within their Offers photographs, trademarks, logos, designs, and other models (Content) belonging to them or to third parties.
Any Seller offering Products for sale via the Marketplace guarantees that they have the right to publish and display all Content, particularly related to their Offers.
In any event, TAEFOO will not and cannot be held liable for any act of counterfeiting or unfair competition produced or communicated on the TAEFOO.COM marketplace by a professional seller, given the limited function and service as a store host with products offered for sale by sellers, each of whom freely publishes their own content.
13.2. Ownership of TAEFOO's Intellectual Property Rights
The User acknowledges TAEFOO's intellectual property rights to the Marketplace that TAEFOO occupies, its components, and related content, and waives any right to contest these rights in any form whatsoever.
The trademarks, logos, slogans, graphics, photographs, animations, videos, software solutions, texts, and any other content published and displayed on the TAEFOO.COM Marketplace, With the exception of Content published by Sellers, these are the exclusive intellectual property of TAEFOO and may not be reproduced, used, or represented without express authorization, under penalty of legal action in any country in the event of an offense.
Any representation or reproduction, in whole or in part, of the Marketplace and its content, by any means whatsoever, without the express prior authorization of TAEFOO, is strictly prohibited and constitutes a reproduction, copy, or infringement punishable by the provisions of the Intellectual Property Code and in connection with the laws on online e-commerce.
In particular, TAEFOO expressly prohibits, without any restriction,
the full or partial copying by extraction, by permanent or temporary transfer of all or a qualitatively or quantitatively substantial part of the content of its database to another medium, or to reproduce a similar or identical marketplace by any means and in any form whatsoever. Any malicious user who intends to economically harm the proper functioning of TAEFOO.COM through illegal processes and/or means will be prosecuted in the country where they operate.
The reproduction, extraction, or reuse, by any means, including methods similar to scraping, of content (photographs, descriptions, etc.) published by TAEFOO or by a Seller.
Users acknowledge TAEFOO's intellectual property rights and agree to respect them in accordance with applicable laws.
TAEFOO grants a personal, non-exclusive, and non-transferable license to Users authorizing them to use the Marketplace solely as a user, under normal conditions of use and in accordance with these Terms and Conditions.
Any other use or exploitation of the TAEFOO.COM Marketplace and its content is excluded from the scope of this license and may not be carried out without the express prior authorization of TAEFOO.
ARTICLE 14. PROTECTION OF PERSONAL DATA + COOKIES
14.1. Regarding processing carried out by TAEFOO.COM
In accordance with regulations relating to the protection of personal data, the Customer is informed that TAEFOO, as the data controller, processes personal data.
14.2. Regarding processing carried out by Sellers
The Seller guarantees that it processes this data in compliance with the rights and obligations arising from and governed by the law of the country in which it operates, "Data Protection and Freedom of Information" and the GDPR.
The Seller may collect and process the personal data of Customers who have placed orders through its store on the TAEFOO.COM Marketplace, solely for the purpose of fulfilling the Order in question or for after-sales service, if necessary. The Seller may also retain Customer data to meet its legal obligations, including tax and accounting obligations, or to manage any potential disputes with its Customers. In accordance with applicable regulations and beyond the legally required period, the Seller will delete the personal data collected from Customers.

To benefit from this system, the Seller may contact TAEFOO at the addresses indicated in the legal notices. This system is easily accessible and free of charge and guarantees that your case will be processed within a reasonable time. TAEFOO will consider complaints filed and will follow up as necessary to resolve the nature and issue raised appropriately. Complaints will be handled promptly and efficiently, taking into account the importance and complexity of the issue. TAEFOO will inform the Seller of the outcome of the internal complaint handling process immediately.
TAEFOO and the Seller will endeavor to reach an amicable settlement within a reasonable timeframe from the date of notification of a complaint. This timeframe may not exceed the timeframe provided for by law, whether submitted by the Seller through the internal complaints system described above or by TAEFOO by email to the complaining seller.
Failing an amicable settlement, TAEFOO and the Seller agree to submit their dispute to the Jakarta Mediation and Arbitration Center, which regulates and regulates e-commerce internationally. IN THE EVENT OF FAILURE OF MEDIATION WITHIN ONE (1) MONTH FROM THE TIME ONE OF THE PARTIES HAS BEEN REFERRED TO THE CASE, ANY DISPUTE ARISING FROM THESE GENERAL CONDITIONS OF USE MAY BE SUBMITTED TO THE COURTS OF JAKARTA, NOTWITHSTANDING MULTIPLE DEFENDANTS OR CALL FOR THIRD-PARTY PROCEEDINGS, INCLUDING FOR EMERGENCY PROCEEDINGS OR CONSERVATORY PROCEEDINGS, IN SUMMARY PROCEEDINGS OR BY APPLICATION.
